Biden HAS done some of it through executive order. You need Congress to make it permanent. And with executive order it’s tenuous and subject to legal challenge. 
Sure Biden could have done it earlier. That’s not on Harris. And even so you can’t escape the fact that when they had the deal, Trump killed it. That’s the point of the commercial, that he put his own political ambitions in front of the country. Thats why this commercial will be so effective because people know it’s true, they know what Trump is really like.
