I don't believe anyone with an IQ of 78 would pass it the second time or no matter how many times they took it.

You would know, or at least have an idea you could confirm or dismiss if you read my post on pager 4.  Generally the pass rate is 35%.  that very low pass rate does not reflect a hard exam, but rather that California is unique in allowing persons from unaccredited law schools to sit for the exam.  The pass rate for those from accredited law schools is 75%, pretty much in range of the national average for other states, though a bit lower, 5% points lower.  First time failure is not a disgrace but it does raise eyebrows in the profession until the person does pass and then goes on, in their career, to prove that the failure was a fluke.
